Terms of use of the Hamburg Marketing GmbH Mediaserver
Terms of use for photos
1. All photos available on the media server are subject to copyright and may only be used in accordance with these terms of use. The term "use" used in the following includes downloading and any form of reproduction, editing, distribution and publication, regardless of the technical form in which this occurs. Before downloading or otherwise using a photo for the first time, the user recognises these terms of use as a binding agreement between him/her and Hamburg Marketing GmbH (HMG).
Unlawful use may be prosecuted under civil and criminal law in accordance with the general laws and these terms of use.
2. HMG authorises the use of the photos free of charge for the following user groups and purposes:
a) Use by private individuals for purely private, non-commercial purposes;
b) Use by
administrative organisations of the districts, counties, municipalities and cities of the Hamburg Metropolitan Region. For the purposes of these terms of use, the term "Hamburg metropolitan region" includes the areas covered by the state treaties, administrative agreements, co-operation agreements and other existing or future agreements relating to the Hamburg metropolitan region in force at the time of use, as well as the district of Ludwigslust, public corporations based in the Hamburg metropolitan region, companies in which administrative institutions of the Hamburg metropolitan region have a financial interest as shareholders or in which administrative institutions of the Hamburg metropolitan region are involved. to which administrative organisations of the Hamburg Metropolitan Region grant subsidies from public funds, in particular business development and tourism institutions as well as municipal marketing companies based in the Hamburg Metropolitan Region, in each case exclusively for the purpose of location marketing for their activities in the Hamburg Metropolitan Region.
c) Use by administrative organisations based outside the Hamburg Metropolitan Region exclusively for editorially designed publications (e.g. brochures) to inform the public about the Hamburg Metropolitan Region.
d) Use for the illustration of journalistic-editorial reporting to inform the public about the Hamburg Metropolitan Region in all media, in particular printed matter, film contributions, websites, etc., provided that no advertising reference is made to services, products and other offers of identifiable providers and/or such providers.
e) It is expressly pointed out that the use on/in products that are offered for sale against a purchase price is not permitted. This applies in particular to merchandising items such as (in a non-exhaustive list) postcards/posters/posters, calendars, books, clothing, bags, decorative items, stationery, CDs/DVDs/Blue Ray Discs and similar data carriers. Use in newspapers and magazines available for purchase is permitted under the conditions set out in d) above.
3. In addition to the user groups/purposes of use specified above under item 2, the photos designated as "For Everyone" in the media server may also be used by other companies, i.e. those in which administrative organisations of the Hamburg Metropolitan Region have neither a direct nor an indirect interest, and by non-profit associations based in the Hamburg Metropolitan Region, provided that the use is exclusively for the purpose of location marketing for their activities in the Hamburg Metropolitan Region without advertising specific services, products and other offers.
Any other use of "For Everyone", in particular advertising and/or commercial use, may be authorised in writing by HMG (contact: markenservice@marketing.hamburg.de) on request in individual cases. HMG is authorised to grant or refuse approval at its own discretion, even without giving reasons. Even after authorisation has been granted, responsibility for use in accordance with section 4 of these Terms of Use remains with the user.
4. The use of the photos is the sole responsibility of the user. Users are obliged to comply with these Terms of Use, the generally applicable laws and other binding legal provisions when using the photos. In particular, they are obliged to respect the rights of third parties (e.g. personal rights, right to one's own image, copyrights, trademark rights) and to comply with criminal law and youth protection regulations.
HMG is not liable for claims arising from unlawful use of the photos. This exclusion of liability does not apply if HMG or its employees have acted wilfully or with gross negligence.
5. Photos that are no longer offered on the media server at the time of the intended use may no longer be used. Embodied (e.g. printed) products that have already been fully produced may - provided they have been produced and offered/distributed in compliance with these terms and conditions of use - be redistributed, unless this conflicts with third-party rights and/or court/contractual injunctions.
In individual cases, a limited period of use has been agreed with the photographers. Corresponding information is provided with the photos shown in each case. The user is only authorised to use these photos until the expiry of the period of use stated with the photo. In the event of unauthorised further use, sections 9 - 11 of these terms of use shall apply.
6. The user himself may not transfer the rights granted to him to third parties. An exception to this is the transfer of photos to companies that have been commissioned by the user with the production/technical realisation of a use permitted under these terms of use and the general laws/legal regulations. Such companies are also permitted to download the files themselves for this purpose, whereby the files must be completely deleted immediately after completion of the order.
7. Editing/modification of the photos is not permitted. This also applies to image montages and electronic editing of any kind and the use of excerpts.
Editing that does not change the basic image content and the image message and does not infringe the rights of third parties or the legitimate interests of HMG may be authorised in exceptional cases following prior written request by HMG (contact: markenservice@marketing.hamburg.de). HMG is authorised to grant or refuse approval at its own discretion, even without giving reasons. Even after authorisation has been granted, responsibility for use in accordance with section 4 of these Terms of Use remains with the user.
8. The user is obliged to include the copyright notice "Photo: Mediaserver Hamburg" plus, if indicated, the name of the photographer (example: "Photo: Mediaserver Hamburg / Max Mustermann") with every publication as a caption or picture caption.
The caption or picture caption must be attached directly to the photo concerned. Collective designations are only permissible in exceptional cases if they allow the copyright notice to be easily and clearly assigned to the photos concerned. A link to the respective image must be created on the web. Exceptions may be authorised in writing by HMG in individual cases.
9. HMG reserves the right to prohibit the use of the photos in individual cases or for the user as a whole in the future for good cause. Good cause includes, in particular, a breach of these terms of use, laws or other legal provisions.
In this case, the user undertakes not to make any further use and to completely delete the photos (downloads) in his possession. Uses in online media, e.g. on the Internet, must be terminated immediately and any photos stored for this purpose must be deleted. Embodied (e.g. printed) products that have already been produced in full may - provided they have been produced and offered/distributed in compliance with these terms of use - be distributed further, unless this conflicts with third-party rights and/or court/contractual injunctions.
10. In the event of a breach of these terms of use, HMG may demand that the user withdraws or corrects his products featuring the photos at his own expense or ceases distribution altogether. In addition, HMG reserves the right to assert legal claims in this case, in particular claims for damages and claims pursuant to Section 11 of these Terms of Use.
11. If the photos are used in violation of these terms of use or the law, the user undertakes to pay a standard market image fee as compensation for licence damages, which is generally calculated according to the annual fee overviews of the Mittelstandsgemeinschaft Fotomarketing (MFM). The user and HMG are at liberty to prove a higher or lower licence fee.
In addition, HMG and the photographers/image authors reserve the right to assert legal claims, in particular for injunctive relief/removal and further claims for damages. The user is obliged to provide HMG immediately upon request with complete and truthful information in writing about the type and scope of his unauthorised use as well as any further information required for the enforcement of or defence against claims and to affirm the accuracy and completeness of this information in writing in lieu of an oath upon request.
12. Users are obliged to send HMG two specimen copies of all uses of the photos (irrespective of the form in which the use has taken place (e.g. printed copies, CD/DVD or similar, online link)) immediately and free of charge upon request.
13. The image data provided has been produced to the best of our knowledge and belief. Nevertheless, HMG accepts no liability for the constant availability of the data, errors in the data or for any resulting system errors or malfunctions. This exclusion of liability does not apply if HMG or its employees have acted wilfully or with gross negligence.
14. The law of the Federal Republic of Germany shall apply with the exception of the UN Convention on Contracts for the International Sale of Goods. Hamburg is agreed as the place of jurisdiction for disputes in connection with the use of the photos and these Terms of Use, insofar as this is legally permissible.
The invalidity of any provision of these Terms of Use shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the intended economic purpose. The same applies in the event of a contractual loophole.
Terms of use for press photos
1. The press photos are subject to copyright and may only be used in accordance with these terms of use. The term "use" used in the following includes downloading and any form of reproduction, editing, distribution and publication, regardless of the technical form in which this occurs. Before downloading or otherwise using a photo for the first time, the user recognises these terms of use as a binding agreement between him/her and Hamburg Marketing GmbH (HMG). Unlawful use may be prosecuted under civil and criminal law in accordance with the general laws and these terms of use.
2. HMG permits the use of the press photos free of charge, but for a limited period of time, to illustrate current journalistic and editorial reporting to inform the public about the Hamburg Metropolitan Region in all media, in particular printed matter, film contributions, websites, etc., provided that no advertising reference is made to services, products and other offers of identifiable providers and/or such providers.
The use of press photos is only permitted within the period specified for the respective press photo. The user is obliged to completely delete any existing copies of the press images (downloads) at the end of the respective utilisation period. HMG reserves the right to remove press images from the website even during the respective period of use. Press images that are no longer offered on the server at the time of the intended use may no longer be used. Embodied (e.g. printed) products that have already been fully produced may - insofar as they have been produced and offered/distributed in compliance with these terms of use - be redistributed, provided that this does not conflict with third-party rights and/or court/contractual injunctions.

Such companies are also permitted to download the files themselves for this purpose, whereby the files must be completely deleted immediately after completion of the order.

6. The user is obliged to state the photo credit/copyright notice specified for the respective press image on the server as a caption or picture caption for each publication.

The term "use" used below includes downloading and any form of reproduction, editing, distribution and publication, regardless of the technical form in which this occurs, including in the form of excerpts and still images from the videos. Before downloading or otherwise using a video for the first time, the user recognises these terms of use as a binding agreement between him/her and Hamburg Marketing GmbH (HMG).
Unlawful use may be prosecuted under civil and criminal law in accordance with the general laws and these terms of use.

e) It is expressly pointed out that the use on/in products that are offered for sale against a purchase price is not permitted. This applies in particular to CDs/DVDs/Blue Ray Discs and similar data carriers, as well as merchandising articles.

Uses of the videos other than those mentioned above under point 2, in particular advertising and/or commercial uses, may be authorised in writing by HMG (contact: DAM@marketing.hamburg.de) in individual cases, taking into account the existing usage rights agreements. HMG is authorised to grant or refuse approval at its own discretion, even without giving reasons. Even after authorisation has been granted, responsibility for use in accordance with section 4 of these Terms of Use remains with the user.
4. Users are responsible for their own use of the videos. Users are obliged to observe these Terms of Use, the generally applicable laws and other binding legal provisions when using the videos. In particular, they are obliged to respect the rights of third parties when using the videos (e.g. personal rights, right to one's own image, copyright, trademark rights) and to comply with criminal law and youth protection regulations.

The use of excerpts and still images as well as shortening, lengthening and combining with other materials is also considered unauthorised editing. Opening and closing credits as well as fade-ins - if available - must be adopted in full for each use.
Editing that does not change the basic film content and the film message and does not infringe the rights of third parties or the legitimate interests of HMG may be permitted in exceptional cases after prior written request by HMG (contact: DAM@marketing.hamburg.de). HMG is authorised to grant or refuse approval at its own discretion, even without giving reasons. Even after authorisation has been granted, responsibility for use in accordance with section 4 of these Terms of Use remains with the user.
8. When publishing the videos, the user is obliged to cite the source: "Video: Mediaserver Hamburg".
If other names of rights holders are mentioned in the film on the Mediaserver, these must be added to the copyright notice (example: "Video: Mediaserver Hamburg / Hamburg Marketing GmbH).
In the case of use in online media (e.g. on the Internet), the source reference must be placed in an easily and clearly assignable manner at the point where the film can be accessed. In the case of journalistic-editorial use in accordance with section 2 d) on television and other electronic media, the user must indicate the source by inserting it into the film, unless it is already included on the film.
For all other authorised uses, the source must also be indicated in an easily and clearly assignable manner, as far as technically possible.
9. HMG reserves the right to prohibit the use of the videos in individual cases or for the user as a whole in the future for good cause. Good cause includes, in particular, a breach of these Terms of Use, laws or other legal provisions.

Terms of use for footage
1. These Terms of Use apply to all footage material (film clips, hereinafter referred to as "Footage") provided by HMG.
Footage may only be used by the user groups listed below and only in accordance with these Terms of Use. The term "use" used below includes downloading or opening the file transmitted by HMG and any form of reproduction, editing, distribution and publication, regardless of the technical form in which this is done (e.g. online and offline), including in the form of excerpts and still images from the Footage.
Before downloading or otherwise using the footage for the first time, the user recognises these terms of use as a binding agreement between him/her and Hamburg Marketing GmbH (HMG).
Unlawful use may be prosecuted under civil and criminal law in accordance with general laws and these terms of use.

b) Use for the illustration of journalistic-editorial reporting to inform the public about the Hamburg Metropolitan Region in the media, in particular film contributions, websites, etc., provided that no advertising references are made to services, products and other offers of identifiable providers and/or such providers.
c) Any further use of the Footage by user groups not listed in these Terms of Use, in particular advertising and/or commercial use, may be authorised in writing by HMG (contact: DAM@marketing.hamburg.de) on request in individual cases, taking into account the existing agreements on rights of use. HMG is authorised to grant or refuse approval at its own discretion, even without giving reasons. Even after authorisation has been granted, responsibility for use in accordance with section 3 of these terms of use remains with the user.
3. The use of the footage is the sole responsibility of the user. Users are obliged to comply with these Terms of Use, the generally applicable laws and other binding legal provisions when using the Footage. In particular, they are obliged to respect the rights of third parties (e.g. personal rights, right to one's own image, copyrights, trademark rights) and to comply with criminal law and youth protection regulations.
HMG is not liable for claims arising from the unlawful use of the Footage. This exclusion of liability does not apply if HMG or its employees have acted wilfully or with gross negligence.
4. If, in individual cases, a period of use or other restrictions are specified for the respective material/clip, these must be observed by the user and complied with on his/her own responsibility.
Footage that is no longer available on the media server at the time of the intended use or whose specified utilisation period has expired may no longer be used.
5. The user himself may not transfer the rights granted to him to third parties. An exception to this is the transfer of the footage to companies that have been commissioned by the user with the production/technical realisation of a use permitted under these terms of use and the general laws/legal regulations. Such companies are also permitted to download the footage themselves for this purpose, whereby the files must be completely deleted immediately after completion of the order.
6. Users from user group 2 a ("administrative organisations" and others) are obliged to state the source reference: "Source: Mediaserver Hamburg" in the opening or closing credits when using the footage or, if not available, in another suitable form that can be clearly attributed (e.g. by insertion).
If, in individual cases, other names of rights holders are mentioned with the respective material/clip, these must be added to the source reference (example: "Source: Mediaserver Hamburg / xxx").
7. HMG reserves the right to prohibit the use of the footage in individual cases or for the user as a whole in the future for good cause. Good cause shall include, in particular, a breach of these Terms of Use, laws or other legal provisions.
In this case, the user undertakes not to make any further use of the footage and to delete the footage in his possession completely. Usage in online media, e.g. on the Internet, must be terminated immediately. Embodied products that have already been produced in full may - insofar as they have been produced and offered/distributed in compliance with these Terms of Use - be redistributed, provided that this does not conflict with third-party rights and/or court/contractual injunctions.
8. In the event of a breach of these Terms of Use, HMG may demand that the user withdraw or correct his productions containing footage at his own expense or cease distribution altogether. In addition, HMG reserves the right to assert legal claims in this case, in particular claims for damages and claims under these Terms of Use.
9. Users are obliged to send HMG two specimen copies of all uses of the films (regardless of the form of use (e.g. CD/DVD or similar, online link)) immediately and free of charge upon request.

Terms of Use Hamburg Schrift ("HamburgSans")
1. Hamburg Marketing GmbH (HMG) is the owner of the exclusive rights of use to the Hamburg typeface developed on its behalf ("HamburgSans" font). This font may only be used in accordance with these terms of use. The term "use" used in the following includes downloading and any form of reproduction, processing, distribution and publication, regardless of the technical form in which this occurs. Before downloading or otherwise using the document for the first time, the user recognises these terms of use as a binding agreement between him/her and HMG.
Unlawful use may be prosecuted under civil and criminal law in accordance with the general laws and these terms of use.
2. HMG authorises the use of the Hamburg-Schrift only for administrative bodies of the districts, counties, municipalities and cities of the Hamburg metropolitan region. For the purposes of these terms of use, the term "Hamburg metropolitan region" includes the areas covered by the state treaties, administrative agreements, co-operation agreements and other existing or future agreements relating to the Hamburg metropolitan region in force at the time of use, as well as the district of Ludwigslust, public corporations based in the Hamburg metropolitan region, companies in which administrative bodies of the Hamburg metropolitan region have a financial interest as shareholders or in which administrative bodies of the Hamburg metropolitan region are involved. to which administrative bodies of the Hamburg Metropolitan Region grant subsidies from public funds, in particular business development and tourism institutions as well as municipal marketing companies based in the Hamburg Metropolitan Region, in each case exclusively for the purpose of location marketing for their activities in the Hamburg Metropolitan Region.
Any further use may be authorised in writing by HMG (contact: DAM@marketing.hamburg.de) on request in individual cases. HMG is authorised to grant or refuse approval at its own discretion without giving reasons. Even after authorisation has been granted, responsibility for use in accordance with section 4 of these Terms of Use remains with the user.
It is expressly pointed out that use on/in products that are offered for sale against a purchase price is not permitted. This applies in particular to merchandising items such as (in a non-exhaustive list) postcards/posters/posters, calendars, books, clothing, bags, decorative items, stationery, CDs/DVDs/Blue Ray Discs and similar data carriers.
3. Editing/altering the font in any form is not permitted. The user may only use the versions of the font provided by HMG.
4. The use of the font is the sole responsibility of the user. When using the font, users are obliged to observe these terms of use, the generally applicable laws and other binding legal provisions. In particular, they are obliged to respect the rights of third parties (e.g. personal rights, copyrights, trade mark rights) and to comply with criminal law and youth protection regulations when using the font.
HMG shall not be liable for claims arising from unlawful use of the font. This exclusion of liability does not apply if HMG or its employees have acted wilfully or with gross negligence.
5. In order to ensure a standardised communication pattern for the Hamburg metropolitan region, the user may only use the version of the Hamburg font currently available on the media server at the time of the first publication of his text. If the font is no longer offered on the media server at the time of the intended use, it may no longer be used.
Completely produced, embodied (e.g. printed) texts may - insofar as they have been produced and offered/distributed in compliance with these terms of use - be redistributed unchanged, provided that this does not conflict with the rights of third parties and/or judicial/contractual injunctions.
Unembodied texts (e.g. online media/internet) must be changed as soon as the user becomes aware of the change to the font or its removal from the media server.
6. The user himself may not transfer the right of use granted to him to third parties. An exception to this is the transfer of the font to companies that have been commissioned by the user with the production/technical realisation of a use permitted under these terms of use and the general laws/legal regulations. Such companies are also permitted to download the files themselves for this purpose, whereby the files must be completely deleted immediately after completion of the order.
7. HMG reserves the right to prohibit the use of the font in individual cases or for the user as a whole in the future for good cause. Good cause includes, in particular, a breach of these Terms of Use, laws or other legal provisions.
In this case, the user undertakes not to make any further use of the font and to completely delete the font templates/fonts (downloads) in his possession. Any use of the font in online media, e.g. on the Internet, must be terminated immediately and any font files saved for this purpose must be deleted. Embodied (e.g. printed) texts that have already been produced in full may - provided they have been produced and offered/distributed in compliance with these terms of use - be redistributed, provided this does not conflict with third-party rights and/or court/contractual injunctions.
8. In the event of a breach of these terms of use, HMG may demand that the user withdraws or modifies its products in which the text is used at its own expense or ceases distribution altogether. In addition, HMG reserves the right to assert legal claims in this case, in particular claims for damages and claims in accordance with Section 9 of these Terms of Use.
9. If the font is used in violation of these terms of use or the law, the user undertakes to pay a standard market fee as compensation for licence damages. The user and HMG are at liberty to prove a higher or lower licence fee.
In addition, HMG reserves the right to assert legal claims, in particular for injunctive relief/remedy and further claims for damages. The user is obliged to provide HMG immediately upon request with complete and truthful information in writing about the type and scope of his unauthorised use and, if necessary, further information required to enforce or defend against claims, and to affirm the accuracy and completeness of this information in writing in lieu of an oath upon request.
10. The font data (fonts) provided have been produced to the best of our knowledge and belief. Nevertheless, HMG accepts no liability for the constant availability of the data, errors in the data or for any resulting system errors or malfunctions. This exclusion of liability does not apply if HMG or its employees have acted wilfully or with gross negligence.
11. The law of the Federal Republic of Germany shall apply with the exception of the UN Convention on Contracts for the International Sale of Goods. Hamburg is agreed as the place of jurisdiction for disputes in connection with the use of the font and these Terms of Use, insofar as this is legally permissible.
The invalidity of any provision of these Terms of Use shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the intended economic purpose. The same applies in the event of a contractual loophole.
